eVA Agent is a product of HéloPep Technologies Pvt. Ltd. ("HéloPep", "we", "us", "our"), a company incorporated in India. Our registered office is located in Mumbai, Maharashtra. eVA Agent provides AI-powered recruitment automation software to enterprise clients ("Customers").

2. Data We Collect

We collect data in two contexts: (a) data about our Customers and their team members who use eVA Agent, and (b) data about Candidates processed through the platform on behalf of our Customers.

Customer account data:

• Name, email address, job title, and company name of account users
• Billing information (processed by our payment provider , we do not store full card numbers)
• Usage logs, feature interaction data, and session metadata

Candidate data (processed as a data processor on behalf of Customers):

• Name, contact details (phone, email), and resume/CV content
• AI-assessed interview responses, scores, and shortlisting outcomes
• Video and voice interview recordings (where the Customer enables this feature)
• Engagement activity (message open rates, response timestamps, nudge interactions)

3. How We Use Your Data

Customer data is used to:

• Provide, maintain, and improve the eVA Agent platform
• Send product updates, security notices, and service-related communications
• Process billing and manage subscription plans
• Respond to support requests and account queries

Candidate data is processed solely as instructed by our Customers. We do not use candidate data for our own AI model training, advertising, or any purpose outside the scope of the service agreement.

4. Legal Basis for Processing

Where GDPR or equivalent regulations apply, we process personal data on the following legal bases:

• Contract: Processing necessary to deliver the service under our agreement with Customers
• Legitimate interests: Product improvement, fraud prevention, and security monitoring
• Legal obligation: Compliance with applicable laws and regulatory requirements
• Consent: Where we rely on consent (e.g. marketing emails), you can withdraw it at any time

5. Data Sharing

We do not sell personal data. We share data only in the following limited circumstances:

• Service providers: Cloud hosting (AWS), payment processing, email delivery, and analytics tools , all bound by data processing agreements
• Legal requirements: Where required by law, court order, or regulatory authority
• Business transfers: In the event of a merger or acquisition, with notice to affected parties

6. Your Rights

Depending on your jurisdiction, you may have the right to:

• Access the personal data we hold about you
• Correct inaccurate or incomplete data
• Request erasure of your data ("right to be forgotten")
• Object to or restrict certain processing activities
• Receive your data in a portable format
• Withdraw consent where processing is consent-based

7. Data Retention

We retain Customer account data for the duration of the subscription and up to 3 years thereafter for legal and audit purposes. Candidate data is retained as configured by the Customer and purged within 30 days of a deletion request or account termination. Interview recordings are stored for a maximum of 12 months unless a shorter period is configured.

9. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by email or by posting a notice in the platform at least 14 days before the changes take effect. Continued use of eVA Agent after the effective date constitutes acceptance of the updated policy.
